Terms of use
Last updated 3 November 2026
These terms are an agreement between you and the operators of higher.fun ("higher.fun", "we", "us"). They cover the higher.fun website, its API and everything on them (the "Service"). By using the Service, or by clicking "I agree", you accept these terms, the privacy notice and the risk notice. If you don't agree, don't use the Service.
1. Who can use higher.fun
- You must be at least 18 and able to enter a binding contract.
- You may not use the Service if you are on a sanctions list, or if you are in, or ordinarily resident in, a country or region that is subject to comprehensive sanctions, or where using the Service is illegal. We may block access from any place, at any time, without notice.
- You may not use a VPN or any other tool to get around a block or restriction.
- You are solely responsible for knowing and following the laws that apply to you, including tax laws.
2. What higher.fun is
- higher.fun is a software interface. It helps you build transactions for Raydium's LaunchLab and CPMM programs on the Solana blockchain. We don't run those programs, the blockchain or your wallet, and we don't control them.
- We never hold your keys, and we never hold your funds when you trade or launch. Every transaction is built in your browser and signed by your own wallet. The one exception is a creator's share of pool fees on a New school coin, which higher.fun collects and pays out weekly. We are not a broker, exchange, custodian, money transmitter, investment adviser or fiduciary, and we don't execute trades for you.
- Coins are created by their creators, not by higher.fun. We don't review, audit, endorse or vouch for any coin, creator or trader. Showing a coin, ranking it, sponsoring it or giving it a safety grade is not a recommendation.
- Nothing on the Service is investment, financial, legal or tax advice, or an offer or solicitation to buy or sell anything.
- Prices, market caps, US dollar values, charts, grades and leaderboards are estimates that may be late or wrong. Don't rely on them alone.
3. Your wallet and your transactions
- You are responsible for your wallet, keys, seed phrase and devices. Anyone with your keys controls your funds. We can't recover them.
- Check every transaction before you sign it. Once signed and confirmed, a blockchain transaction is final. We can't cancel, reverse or refund it, including one sent by mistake, to the wrong coin, or at a bad price.
- Network fees, slippage, failed transactions and delays are part of using a blockchain and are at your own risk.
4. Fees
Launching a coin costs a flat launch fee. Each coin uses one of two fee modes, chosen at launch, which decide the trading fees and what higher.fun and the creator earn. Raydium charges its own fees on top. The current fees are on the fees page and are shown before you sign. Fees paid on-chain are not refundable. We may change fees for new coins at any time.
5. Creating a coin
- If you launch a coin, you alone are responsible for it and for everything you say about it, on higher.fun or anywhere else. You confirm you have the rights to its name, ticker and image.
- You must not launch a coin that is, or is promoted as, a security, an investment contract, a share in profits, or a promise of returns, unless you have done everything the law requires. You must not promise buyers anything you don't control.
- If you launch a coin for an X or GitHub account, you confirm you are allowed to, and you accept that the named account, not you, receives its creator fees.
- Coins can't be deleted from the blockchain. Graduation to Raydium is not guaranteed.
6. Rules of conduct
You agree not to use the Service to:
- break any law, or launder money, finance terrorism, or evade sanctions or taxes;
- manipulate markets, including wash trading, spoofing, pump-and-dump schemes, coordinated rug pulls or bundling to mislead buyers;
- defraud, scam or deceive anyone, or impersonate any person, project or brand;
- post anything illegal, infringing, sexually explicit, involving minors, hateful, harassing, threatening or violent;
- spam, phish, or post links to malware or wallet drainers;
- attack, overload, scrape at scale, reverse engineer or interfere with the Service, or get around its limits or security.
7. Content
- Everything you post (coin names, images, descriptions, profiles, chat and replies) is public. Once pinned to IPFS or recorded on-chain, it is effectively permanent.
- You keep ownership of your content, and you give higher.fun a worldwide, free, non-exclusive, perpetual licence to host, copy, display and distribute it as part of running and promoting the Service.
- We may hide, remove or refuse any content, coin, profile or account on the Service, at our discretion and without notice. We can't remove anything from the blockchain or IPFS. We don't monitor all content and aren't responsible for what other people post.
- To report infringing or illegal content, use the report button or email [email protected].
8. Risks you accept
Memecoins are extremely risky. Most lose most or all of their value, often within minutes. Prices can be manipulated, creators and holders can sell at any time, and smart contracts, wallets and blockchains can fail or be exploited. You use the Service entirely at your own risk and accept that you may lose everything you put in. Read the risk notice.
9. Third parties
The Service relies on others, including Solana, Raydium, wallet providers, Privy, Cloudflare, IPFS pinning services, RPC providers and price sources. We don't control them and aren't responsible for what they do, for their outages or errors, or for their terms.
10. No warranties
The Service is provided "as is" and "as available", with all faults and without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy and uninterrupted or error-free operation, to the fullest extent the law allows.
11. Limits on our liability
To the fullest extent the law allows, higher.fun and its operators, contributors and service providers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, tokens, funds, data, goodwill or opportunity, arising from or related to the Service, any coin, any transaction or any third party, however caused and even if we were told it was possible. Our total liability for all claims will not exceed the greater of US$100 or the fees you paid directly to higher.fun in the 12 months before the claim.
Some places don't allow some of these limits; there, they apply as far as the law allows.
12. Indemnity
You will defend, compensate and hold harmless higher.fun and its operators and contributors from any claims, losses, liabilities, costs and legal fees arising from your use of the Service, your coins, your content, your breach of these terms, or your breach of any law or anyone's rights.
13. Disputes
- Before starting any claim, you agree to email [email protected] and try for 30 days to settle it informally.
- To the extent the law allows, any dispute will be resolved individually by final and binding arbitration, not in court, and you waive any right to a jury trial or to take part in a class, collective or representative action.
- Any claim must be brought within one year of when it arose, or it is permanently barred, where the law allows.
14. Ending access
We may suspend or end your access to the Service, or change or shut down any part of it, at any time and for any reason, without notice or liability. Your coins and funds stay on the blockchain and remain reachable with other tools. Sections 5 to 15 survive.
15. Everything else
- We may change these terms. The date at the top shows the latest version. Continuing to use the Service after a change means you accept it.
- If any part of these terms can't be enforced, the rest still applies. Not enforcing a right isn't a waiver of it.
- These terms, the privacy notice and the risk notice are the whole agreement between you and us about the Service. You can't transfer them; we can.
